1. Agreement to Terms

By accessing or using Migration Desks (the “Service”), provided by Migration Desks (“we”, “our”, or “us”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

Migration Desks is a cloud-based visa application management platform designed for registered migration agents and immigration consultants. The Service provides tools for:

• Client and lead management
• Document verification and storage
• Application tracking and workflow automation
• Appointment scheduling
• Communication and notification management
• Compliance and reporting tools

3. Eligibility

To use the Service, you must:

• Be at least 18 years of age
• For agent accounts: Hold a valid MARA registration (Australia) or IAA license (New Zealand)
• Have the legal authority to enter into this agreement
• Provide accurate and complete registration information

4. Account Registration and Security

4.1 Account Creation

You must register for an account to use the Service. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate and current.

4.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must:

• Use a strong, unique password
• Enable multi-factor authentication where available
• Notify us immediately of any unauthorized access
• Not share your account credentials with others

5. Subscription and Payment

5.1 Subscription Plans

The Service is offered on a subscription basis. Details of available plans, features, and pricing are available on our Pricing page.

5.2 Billing

Subscription fees are billed in advance on a monthly or annual basis. You authorize us to charge your designated payment method for all applicable fees.

5.3 Free Trial

We may offer a free trial period. At the end of the trial, your account will be charged unless you cancel before the trial expires. Trial terms may vary and are specified at signup.

5.4 Refunds

Annual subscriptions may be eligible for a pro-rata refund within the first 30 days. Monthly subscriptions are non-refundable. Contact support for refund requests.

6. Acceptable Use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights of others
• Upload malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to the Service or other accounts
• Interfere with the proper functioning of the Service
• Use automated systems to access the Service without permission
• Collect or harvest personal information without consent
• Engage in fraudulent or deceptive practices
• Use the Service for any purpose other than legitimate migration services

7. Your Content and Data

7.1 Ownership

You retain ownership of all content and data you upload to the Service (“Your Content”). We do not claim ownership of Your Content.

7.2 License Grant

By uploading Your Content, you grant us a limited, non-exclusive license to store, process, and display Your Content solely for the purpose of providing the Service.

7.3 Responsibility

You are solely responsible for Your Content and ensuring it complies with applicable laws and regulations. You represent that you have all necessary rights to upload and process the content.

8. Intellectual Property

The Service, including its design, features, code, and documentation, is owned byMigration Desks and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.

9. Third-Party Services

The Service may integrate with third-party services (payment processors, email services, etc.). Your use of such services is governed by their respective terms and privacy policies. We are not responsible for third-party services.

10. Disclaimers

10.1 Service Availability

The Service is provided “as is” and “as available” without warranties of any kind. We do not guarantee uninterrupted, secure, or error-free operation.

10.2 Professional Advice

The Service is a management tool and does not constitute legal or immigration advice. Users remain solely responsible for ensuring compliance with immigration laws and regulations.

11. Limitation of Liability

To the maximum extent permitted by law, Migration Desks shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or business opportunities arising from your use of the Service.

Our total liability shall not exceed the fees you paid to us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Migration Desks, its officers, directors, employees, and agents from any claims, damages, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your Content uploaded to the Service

13. Termination

13.1 By You

You may terminate your account at any time by contacting support. Upon termination, you will have 30 days to export your data.

13.2 By Us

We may suspend or terminate your account for violation of these Terms, non-payment, or at our discretion with 30 days' notice. Immediate termination may occur for serious violations.

13.3 Effect of Termination

Upon termination, your access to the Service will cease. We may retain certain data as required by law or for legitimate business purposes.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Victoria, Australia. Any disputes shall be resolved in the courts of Victoria, Australia, unless otherwise required by law.

15. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or notice on the Service at least 30 days before taking effect. Continued use after changes constitutes acceptance.

16. General Provisions

• Entire Agreement: These Terms constitute the entire agreement between you and us.
• Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
• Waiver: Failure to enforce any provision does not constitute a waiver.
• Assignment: You may not assign your rights without our consent.
